The Blockchain Association recently filed an amicus brief in the SEC case against former Coinbase Global product manager Ishan Wahi and his associates. The association expressed its support for the defendants’ argument that the SEC had exceeded its authority in the case,citing the Supreme Court’s “major questions” doctrine and listing ways that alleged regulation by enforcement causes harm. They argued that token creators,holders,and users have no means to counter these pronouncements,exchanges may reconsider listing tokens at issue,and market participants are unable to determine what is or is not a security.
